Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Fracton application (the "Service") operated by us.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Description of Service
Fracton is a privacy-focused tool designed to help you map, understand, and manage your digital footprint. The Service operates on a zero-knowledge principle, meaning your data is encrypted in a way that we, the service providers, cannot access it.
2. User Responsibilities
- You are responsible for safeguarding your own encryption key and/or passphrase.
- You agree that you are solely responsible for the data you store within Fracton and for backing up your data.
- You agree not to use the Service for any illegal or unauthorized purpose.
Because of our zero-knowledge architecture, we cannot recover your encryption key if you lose it. Losing your key will result in the permanent loss of access to your data stored in the Cloud Vault.
3. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
We do not warrant that the service will function uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; or that the results of using the service will meet your requirements.
4. Limitation of Liability
In no event shall Fracton, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our service by any third party.
5. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the service provider is based, without regard to its conflict of law provisions.
7. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page.
